10-Day Letter aka Form 1205

When arrested for DUI in Georgia, your license will usually be confiscated for failing to submit to the State's blood alcohol test. This may be by blood, breath, urine or otherwise. In exchange for your license, the arresting officer should provide you with a 1205 notice.

The officer may explain to you that the 1205 notice will serve as your license for the next 30 days, and thereafter your license may automatically be suspended.  Make sure you read the fine print.

The Form 1205 includes language putting you on notice that you have ten business days to appeal the suspension.  YOU MUST ACT QUICKLY to avoid an automatic 1 year suspension of your driver's license. In order to avoid the suspension, a letter must be sent to the Department of Driver Services, appealing the suspension and including a $150.00 charge for the administrative hearing.

Again, failure to send in this letter could result in an automatic 1 year suspension of your driver's license merely for failing to submit to blood alcohol testing.
