PTSD and lawsuits related to car accidents

Georgia residents who have been injured in a car accident caused by another motorist might also suffer from post-traumatic stress disorder. It is possible to file a lawsuit that asks for compensation for their physical injuries as well as the PTSD, but there may be some additional challenges involved in proving the PTSD and its relationship to the accident.

They will have to prove that they were diagnosed with PTSD by a qualified doctor and that it is related to the accident. It might be necessary to have an expert medical witness testify. The defendant might try to point to other incidents in the injured person's past that could have led to PTSD or to a previous diagnosis. However, if the victim already had PTSD and the accident caused it to return, this could also be significant.

One additional challenge with relating a PTSD diagnosis to an accident is that this diagnosis may come months or years after the accident. Meanwhile, the victimd may have settled without filing a lawsuit, and this settlement might leave them unable to make any further claims.

Because diagnosing injuries and documenting them sufficiently can be so important after a motor vehicle accident, people who have been injured in one might want to speak to an attorney to discuss what they should do next. If the accident is caused by a reckless or distracted driver and the compensation offer from the insurance company is insufficient, a lawsuit might be necessary. Even if the offer of compensation seems reasonable, the victims may want their attorneys to negotiate with the insurance company since there might be other elements that they have not considered, including the possibility that they could be suffering from other conditions that remain undiagnosed.
